Charity awarded thousands of pounds in court win as energy broker mis-sold business energy contracts

Business Energy Claims is delighted to announce the recovery of several thousands of pounds for Caritas Care from their energy broker, Bionic (formerly Make it Cheaper), following a recent win at trial by our appointed solicitor, PG Legal.

Caritas care, a Lancashire charity who provide care and support to children, families, and communities, entered into a total of 14 fixed term contracts with Bionic for their energy agreements that averaged two years in length.

Callum Thompson, director at Business Energy Claims, said “When Caritas Care approached us, we were disappointed to hear of brokers mis-selling energy contracts to a charity who specialise in supporting children, and the extent of the hidden fees.”

He continued, “After reviewing their 14 contracts, it was clear they had been mis-sold. Bionic had a duty to inform the customer of the commissions earned from their contracts. This was not the case and it was clear that the rates included undisclosed commissions.”

A hearing resulted in the judge ruling in favour of the charity. The judge ruled that the broker was acting as an agent for the client, and as such neglected their fiduciary duty to act in Caritas Care’s best interests.

Callum concluded, “We are thrilled to announce this recent win at trial for Caritas Care – knowing we have successfully recovered thousands of pounds for a charity during such a difficult period makes the judgement that little bit sweeter. This success adds to our wins at trial, and we look forward to assisting many more clients.”
